Please read these Terms and Conditions ("Terms") carefully before using the website (the "Site") or engaging the services of Phenomenal Ascensions LLC ("Company," "we," "us," or "our"). By accessing the Site or entering into a service arrangement with the Company, you ("User" or "Client") agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Site, submitting a contact or inquiry form, or entering into a service agreement with the Company, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not access or use the Site or the Company's services.

2. Description of Services

Phenomenal Ascensions LLC provides Call Center as a Service (CCaaS) solutions for service-based business owners. Services include, but are not limited to:

Design, build-out, and operation of white-label call center pods located in Austin, Texas
Staffing, hiring, onboarding, training, and management of call center personnel
Lead generation and paid advertising campaign management under Client's brand
Day-to-day call center operations management, quality assurance, and performance reporting
Remote access dashboards and bi-weekly performance and payout reporting

All services are governed by the Call Center as a Service Agreement executed between the Company and each individual Client. These Terms are supplemental to and do not replace the Service Agreement.

3. Eligibility

The Site and Company services are intended for adults aged 18 years or older with legal capacity to enter into binding contracts. By using the Site or engaging our services, you represent and warrant that you meet this requirement. Services are designed for legitimate service-based business owners and entrepreneurs. The Company reserves the right to decline service to any person or entity at its sole discretion.

4. No Income or Results Guarantee

THE COMPANY MAKES NO REPRESENTATION OR GUARANTEE OF ANY SPECIFIC INCOME, REVENUE, QUALIFIED CLOSES, LEAD VOLUME, OR BUSINESS OUTCOME. Results depend on numerous factors including but not limited to Client's offer quality, market demand, advertising platform performance, team execution, and economic conditions. Any financial figures referenced on the Site or in marketing materials are illustrative examples only and are not guarantees or projections of actual results. Individual results will vary significantly.

5. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, designs, and operational systems developed by the Company, is the exclusive property of Phenomenal Ascensions LLC and is protected by applicable intellectual property laws. Users may not reproduce, distribute, modify, or create derivative works from any Company content without prior written consent.

Client's brand assets remain the exclusive property of the Client. The Company receives only a limited license to use Client's brand solely for performing services under the Service Agreement.

6. Acceptable Use

Users agree not to use the Site or Company services to:

Engage in any unlawful, fraudulent, deceptive, or harmful activity
Violate any applicable federal, state, or local law or regulation
Infringe upon the intellectual property rights of the Company or any third party
Interfere with or disrupt the operation of the Site or Company systems
Attempt to gain unauthorized access to any portion of the Site or Company infrastructure
Make false or misleading representations about the Company's services

7. Third-Party Links and Services

The Site may contain links to third-party websites or services. The Company does not endorse and is not responsible for the content, privacy practices, or accuracy of any third-party website. Your use of third-party sites is at your own risk and subject to the terms of those sites.

8. Disclaimers

THE SITE AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE COMPANY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHENOMENAL ASCENSIONS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR COMPANY SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS OPPORTUNITY.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the dispute resolution provisions set forth in the Service Agreement, or if no such agreement exists, shall be resolved in the courts of Travis County, Texas.

11. Modifications

The Company reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated effective date. Continued use of the Site or services following the posting of changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
